On June 25, 2025, the Yantai Intermediate People's Court issued a first-instance judgment (Case No.: (2024) Lu 06 Min Chu 122) in the case of trademark infringement and unfair competition filed by our client, Foshan Haitian Flavouring and Food Co.,Ltd., against Yantai XX Food Co., Ltd., Mr. Song XX, and Yantai XXX Food Co., Ltd.

The first-instance court recognized "海天" as a well-known trademark and determined that the packaging of Haitian's "味极鲜 (Wei Ji Xian)", "鲜味生抽(Xian Wei Sheng Chou)" , and "老抽王(Lao Chou Wang") constitutes distinctive product packaging with a certain influence. The court ruled that the defendants' actions constituted both trademark infringement and unfair competition.

In this case, the defendants voluntarily disclosed their shipment volume through WeChat conversations, promoted their nationwide sales reach via WeChat Moments, and repeatedly compared their infringing products with Haitian's products in promotional materials. The court ultimately found evidence of willful infringement and a substantial scale of infringement, leading to the full award of our client's claimed damages of 3.2 million RMB.
